“I Love My Roland” Photo Contest: Terms and Conditions (amended May 19, 2008) By entering the “I Love My Roland” Photo Contest (the “Contest”) you agree to be bound by these Terms and Conditions. 1. SPONSOR. This Contest is sponsored by Roland DGA Corporation, 15363 Barranca Parkway, Irvine, CA 92618-2216 (hereafter referred to as “Roland”). 2. ELIGIBILITY. Open to all current customers of Roland equipment residing in North America (excluding Rhode Island, Puerto Rico and the province of Quebec) or South America (excluding Brazil). Entrants must be over the age of majority in the jurisdiction in which they reside. Void wherever prohibited by law. Employees of Roland DGA, their affiliates, parent companies, participating vendors, subsidiaries and advertising and promotion agencies, and anyone working directly on this program, product and promotion and the immediate family members or those living in the same household of each are not eligible to enter. 3. CONTEST DESCRIPTION. The Contest is skill-based with a random drawing amongst all eligible entrants and a random drawing amongst finalists, and the object is to submit a photograph for judging for the chance to win prizes as described below. This Contest, including all entries, will be conducted in English. This Contest is conducted in the United States of America, and entries and registration information is collected on computers located in the U.S.A. This contest is governed by California law, and by entering you agree to accept jurisdiction and venue in the Courts of the State of California, U.S.A. 4. ENTRY PERIOD. The Contest begins at 12:01 AM PT on March 14, 2008 and ends at 11:59 PM PT July 31, 2008 (Entry Period). All entries must be received prior to the close of the Contest Entry Period. Any entries submitted after the deadline will be disqualified. 5. HOW TO ENTER. No purchase necessary. To enter online visit the Contest website located at http://www2.rolanddga.com/promo/ILoveMyRoland/entryform.aspx and register. You'll be asked to provide your name, company name, company address, date of birth, phone number, e-mail address and the type of Roland products you use. You must then submit your image(s), and then click on the "submit" button to be entered into the Contest. 6. ENTRY CRITERIA. All entries submitted must be original and must have been created and owned exclusively by the entrant submitting the creation. Roland disclaims any and all liability for any infringement of any 3rd parties’ rights in any submission caused by any entrant. 7. CATEGORIES/ENTRY LIMITS. For purposes of this Contest each entrant may submit up to five (5) images per each eligible product, all of which will be considered a single entry, in each of the following product categories: Printer; Printer/Cutter; Sublimation Printer; Cutter; Milling Machine; Photo Impact Printer; Engraver; and Scanner. Any images submitted by the same person in excess of five (5) per product category will be disqualified. 8. PHOTO SUBJECT RESTRICTIONS. Photos must be appropriate for public display, posting on a public website and in marketing material. Obscene, provocative or otherwise questionable content will not be considered. Roland retains sole discretion as to what constitutes inappropriate content. 9. SUBMITTING DIGITAL IMAGES. Digital images should be submitted using the online entry form. Images should be formatted to 72 dpi, no larger than 1 MB or 1000 pixels x 1,300 pixels and no smaller than 300 K or 800 pixels x 1,040 pixels. Panoramic photos are not eligible. Images must be submitted in JPEG (at high quality)format. File sizes must be less than 500K per image. Roland reserves the right to request a larger formatted photo of the 25 finalists. Exact specifications to be determined at a later date. 10. IMAGE MODIFICATIONS. Minor digital enhancement is permitted, but images that have been significantly modified or appear unnatural will be disqualified. Not Permitted: no borders or frames may be added to images; no watermarks, signatures, or copyright notices may be added to images; adding or replacing elements in an image; or artistic filters. Permitted Modifications: images may be cropped and rotated as necessary as long as the rectangular format is maintained and the size is within the specifications above; images may be resized as long as the aspect ratio is maintained; red-eye removal and spot editing; one-step enhancement (such as "AutoFix", "QuickFix", "Auto Levels", etc.); use of filters to sharpen, soften, blur, despeckle, or remove noise; use of corrective functions to improve the natural appearance of the image, such as levels, contrast, brightness, curves, intensity, tone, hue, saturation, lightness, value, color balance, and tint. 11. JUDGING. A panel of judges consisting of Roland employees and industry experts will review eligible entries and select twenty-five (25) Finalists based upon the following criteria: Personality; Creativity; and Enthusiasm for Roland products. Judges will announce the finalists, on or about August 29, 2008. The decisions of the judges are final and binding. The winners of the Apple iPod touch, 8GB, will be selected in a random drawing from all eligible entrants on or about August 29, 2008. The winner of the Grand Prize will be selected in a random drawing from the twenty-five (25) Finalists on or about September 19, 2008 12. RIGHTS TO USE ENTRIES. All Entries (including non-winning entries) become the property of Roland and will not be returned. As a condition of submitting your image and/or accepting a prize, you agree to grant Roland an irrevocable and perpetual royalty-free worldwide license to use, reproduce, publish, alter, display and/or copyright the image, in print and on the web for the non-exclusive benefit of Roland. 13. WINNERS' NOTIFICATION. Twenty five (25) First Place winners will be announced online on August 29, 2008. The winners of the Apple iPod touch, 8GB, will be announced online on August 29, 2008. One (1) Grand Prize winner will be announced September 19, 2008. Winners will be notified by phone or by U.S. mail, overnight mail, or e-mail at the discretion of the Roland. Winners will be required to provide Roland with an Affidavit of Eligibility/Liability/Publicity release and IRS tax form W-9 or IRS tax form W8-BEN. If winner does not reply to such notification, the notification is undeliverable, and/or the forms are not completed and returned within 10 days of prize notification, the winner may be disqualified and an alternate winner will be selected based upon the judging criteria. Prizes will be awarded within approximately 60 days of notification. 14. PRIZES.
No substitution or transfer of prize permitted, except by Roland who reserves the right to award a prize of equal or greater value if advertised prize is unavailable. Any costs or expenses associated with the acceptance and use of any Contest Prizes are the sole responsibility of the recipient. Roland is not responsible for any damages or injury incurred by any entrant and/or his or her companions as a result of winning. Prize awards may be subject to country specific restrictions. 15. TAX INFORMATION. All taxes, if any, on the prizes are the sole responsibility of the recipient. The recipients agree to provide any required information necessary to satisfy taxing authorities and to allow Roland to prepare and submit any required documentation related thereto prior to the award of their prize. 16. CONDITIONS OF PARTICIPATION. This Contest is void where prohibited. Submission of an image and/or acceptance of a prize constitutes permission for Roland to use that entrant's name, likeness, picture and Entry for promoting Roland products without additional compensation unless and where prohibited by law. By entering this Contest you agree to and hereby release and hold harmless Roland from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this Contest, use or license of your Entry, or any prize. If you do not want to grant the foregoing release, please do not enter the Contest. By submitting your Entry in the Contest, you represent and warrant that it is your sole original work, and that you have obtained any and all consents, model releases, approvals or licenses required for you to submit your Entry and comply with all of these Terms and Conditions, including obtaining the written consent of all 3rd parties, where applicable. 17. RULES AMENDMENT AND INTERPRETATION. The Contest and its continuing terms and conditions, benefits and participation are offered to Participants at the sole discretion of Roland. Roland reserves the right to amend or interpret the Terms and Conditions or official Contest communications and any element or elements arising under or relating to the Contest at any time, upon published notice to participants on Roland’s website (the Site). A participant shall be deemed to have notice of any such amendments or interpretations upon publication of the same on the Site and shall be deemed to have accepted such amendments or interpretations by virtue of a participant's continuing participation in the Contest. Should a participant not wish to continue to participate in the Contest pursuant to the prevailing Terms and Conditions, as amended or interpreted, a participant may terminate participation in the Contest by notifying Roland. 18. LIMITATION ON LIABILITY. Roland is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of Entries. Roland assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Roland is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Roland, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Roland reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest. By participating in the contest, you agree to release and hold harmless Roland and its employees, officers, affiliates, agents, and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest, including infringement of intellectual property rights. Roland and its employees, officers, affiliates, agents, and advertising and promotional agencies assume no responsibility or liability for any damages, injuries, claims, causes of actions, or losses of any kind arising in whole or in part from this contest.
